CONDITIONS
OF SUBMISSION AND REPRODUCTION OF PICTURES
Your retention of our pictures implies that you
accept these conditions in their entirety. If these conditions
are unacceptable, please return our pictures immediately.
- In these Conditions, the term picture
includes a digital picture file, photographic print,
transparency or negative; the term reproduction includes
any form of publication or copying of the whole or part
of any picture, whether by printing, photography, slide
projection, xerography, artist’s reference,
artist’s illustration, layout or presentation,
electronic or mechanical reproduction or by any other
means.
- Our published reproduction rates are per single use. Rates for repeat use
are subject to negotiation.
- All pictures other than digital
picture files obtained from French fotos/Small
Print are borrowed only, and must be returned within two
calendar months of receipt, after which they are liable
to a holding fee (see current scale of fees) unless
permission has been obtained to keep them longer without
such fee.
- Our delivery note will list all the
pictures delivered to you, which shall be presumed to
have been received in good condition unless within two
days of receipt you notify us in writing of any
discrepancy or damage.
- A service fee (see rates) is generally charged if no pictures are
ultimately used.
- All loss or damage must be paid for.
Neither picture nor mount should be marked. If we have to
remove your marks, there will be a charge (see rates).
- The individual to whom pictures are
lent or sent is personally responsible for their
safe-keeping and return in good condition, for informing
us of use, and for seeing that payment is made.
- The borrowing or purchase of a picture
does not carry with it the right to reproduce.
Reproduction will be deemed to imply acceptance of our rates and conditions. Clients who proceed to
reproduction before negotiating rates must expect to pay
current rates in full.
- When pictures are returned, full
details of use, including rights required, must be
supplied.
- Payment for reproduction need not be
made until publication or transmission, but is then due
immediately at current rates unless otherwise negotiated.
- Payment for service and holding fees,
and charges for loss or damage, is due immediately. Our
terms are 30 days net. UK Late Payment of Commercial
Debts (Interest) Act 1998: Interest at 8% above UK base
rate and statutory compensation will be charged on
overdue payments.
- All pictures reproduced must be
credited to ‘French fotos’. If this
credit is not given, an additional charge equivalent to
50% of the reproduction fee will be incurred.
- Pictures must not be passed from one
client to another, even within the same organisation,
without our permission. Should this be done, both clients
may be charged the appropriate fees.
- A copy of any publication in which our
pictures are reproduced must be sent to us on or
preferably before publication.
- Pictures despatched by us but not
received by you or received damaged are our
responsibility. Pictures despatched by you but not
received by us or received damaged are your
responsibility and if lost or damaged in the return post
must be paid for by you.
